1. (a) If the applicant is an individual, the applicant shall complete, sign, and submit the disclosure forms specified in 316.04(a) and (b).

2. (b) If the applicant is not an individual, the applicant shall complete, sign, and submit:

   1. (1) A business disclosure form in accordance with Env-Sw 316.04(b) for:

      1. a. The applicant;

      2. b. Each entity that is, or is proposed to be:

         1. 1. A partner;
         2. 2. An entity contracted with the applicant to operate, manage, or supervise the facility or activities for which approval is being sought;
         3. 3. An entity holding 10% or more of the applicant's debt; or
         4. 4. An entity holding 10% or more of the applicant’s equity; and
      3. c. The parent corporation, holding corporation, and any other entity that exercises control over the facility or activities for which approval is being sought; and

   2. (2) A personal disclosure form in accordance with Env-Sw 316.04(a) for each individual who has, or who is proposed to have, any of the following relationships with the applicant:

      1. a. Director;
      2. b. Partner;
      3. c. Officer;
      4. d. Any managerial or supervisory or substantial decision-making authority and responsibility for the management of facility operations or the activity(s) for which approval is being sought;
      5. e. Holder of 10% or more of the applicant’s debt; or
      6. f. Holder of 10% or more of the applicant’s equity.
3. (c) If the applicant and the proposed facility operator are not the same, the applicant also shall submit a personal disclosure form in accordance with Env-Sw 316.04(a) and a business disclosure form in accordance with Env-Sw 316.04(b) for the facility operator as though the facility operator is the applicant and as described in (a) and (b), above.
4. (d) If for a research and development permit in accordance with Env-Sw 312, the lead investigator shall submit a personal disclosure form in accordance with (a) above.
