1. (a) The applicant or registrant for any approval relating to a proposed activity located in an area of threatened or endangered species shall provide a copy of the complete application or registration and a notice of filing as specified in (b) below to each of the following entities:

   1. (1) The New Hampshire department of fish and game; and
   2. (2) The New Hampshire department of natural and cultural resources, natural heritage bureau.
2. (b) The notice of filing shall be provided in accordance with Env-Sw 303.05 and contain a request for the recipient(s) of the notice to submit to the department, within 30 days following receipt of the notice of filing, written comments concerning the adequacy of the application relative to protecting threatened or endangered species.
