The department shall call a financial assurance mechanism when:

1. (a) The permittee declares or files for bankruptcy;
2. (b) The permittee does not replace their financial assurance mechanism in accordance with Env-Sw 1405.03;
3. (c) The permittee fails to conduct closure obligations;
4. (d) The facility’s permit is revoked or suspended in accordance with Env-Sw 306.04; or

5. (e) One or more of the trigger events for closure as specified in Env-Sw 1006.01 exist.
