1. (a) Except as provided by (b) below, all active and routine facility operations, including waste disposal, facility inspections, maintenance, repairs, and monitoring, shall occur between 6:00 a.m. and 6:00 p.m. under normal non-emergency circumstances.

2. (b) Regular operating hours outside of the normal 6:00 a.m. to 6:00 p.m. window specified by (a) above shall be allowed only if:

   1. (1) Approved by the department in the terms and conditions of the permit based on information provided in an application which demonstrates:

      1. a. The facility will not successfully operate within the normal window; and
      2. b. The alternative hours will not result in problems relating to safety, access control, or nuisances; or
   2. (2) The facility is a limited private facility and receives no waste from off-site locations.
