In order to minimize contamination, reduce risk of exposure, or promote more timely remediation, the responsible party may begin remediation at a site before a remedial action plan is submitted to or approved by the department, provided the responsible party:

1. (a) Notifies the department in writing of the proposed activities to be conducted prior to beginning remediation;
2. (b) Incorporates the self-initiated remediation measures into the remedial action plan that is submitted to the department for approval; and
3. (c) Complies with all other applicable local, state, and federal requirements.
