1. (a) Recyclable materials used in a manner constituting disposal as described in Env-Hw 803.03 shall be subject to this part.
2. (b) Generators and transporters of recyclable materials that are used in a manner that constitutes disposal shall be subject to the applicable requirements of Env-Hw 300, Env-Hw 500, and Env-Hw 600.
3. (c) Owners and operators of facilities that store recyclable materials that are to be used in a manner that constitutes disposal, but that are not the ultimate users of the materials, shall be subject to Env-Hw 300 and Env-Hw 700.
4. (d) Subject to 40 CFR 266.20(b) and (c), owners and operators of facilities that use recyclable materials in a manner that constitutes disposal shall be subject to Env-Hw 300, Env-Hw 700, and Env-Hw 1200.
