1. (a) Recyclable materials, as defined in Env-Hw 801.02(b), shall be managed as set forth in Env-Hw 804 unless specifically exempt as specified in Env-Hw 401.03(b)(34) through (38).

2. (b) Except as set forth in Env-Hw 804.02, a person who manages recyclable materials shall comply with the following requirements:

   1. (1) A generator of recyclable materials shall be subject to Env-Hw 500;
   2. (2) A transporter of recyclable materials shall be subject to Env-Hw 600;
   3. (3) An owner or operator of a facility that stores recyclable materials before they are recycled, including a facility that also recycles the materials, shall be subject to Env-Hw 300 and Env-Hw 700; and

   4. (4) An owner or operator of a facility that recycles recyclable materials without storing the materials before they are recycled shall be subject to the following:

      1. a. Notification requirements as set forth in Env-Hw 702;
      2. b. Manifest requirements as set forth in Env-Hw 703; and
      3. c. Biennial reporting requirements as set forth in Env-Hw 705.03.
