The operator of a facility shall:

1. (a) Treat, store, or dispose of wastes according to best engineering judgment and with the best available technology;
2. (b) Design and operate the facility so as to minimize the quantity and impact of planned and non-planned releases of hazardous waste or waste constituents into the environment;
3. (c) Use the best available solution for managing the hazardous wastes received; and

4. (d) Comply with the following requirements and standards:

   1. (1) 40 CFR 264, Subpart I - use and management of containers;

   2. (2) 40 CFR 264, Subpart J - tank systems, including:

      1. a. Determining the absence or presence of free liquids by using the paint filter liquids test, test method 9095B in EPA publication SW-846, available as noted in Appendix B; and
      2. b. The requirements for maintaining protective distances as required in Tables 2-1 through 2-6 of the National Fire Protection Association’s “Flammable and Combustible Liquids Code,” NFPA 30, 1977 or 1981, as incorporated by reference in 40 CFR 260.11 and available as noted in Appendix B;
   3. (3) 40 CFR 264, Subpart K - surface impoundments;
   4. (4) 40 CFR 264, Subpart L - waste piles;
   5. (5) 40 CFR 264, Subpart M - land treatment;
   6. (6) 40 CFR 264, Subpart N - landfills, including determining the absence or presence of free liquids by using the paint filter liquids test, test method 9095B in EPA publication SW-846, available as noted in Appendix B;
   7. (7) 40 CFR 264, Subpart O - incinerators;
   8. (8) 40 CFR 264, Subpart W - drip pads;
   9. (9) 40 CFR 264, Subpart X - miscellaneous units;
   10. (10) 40 CFR 264, Subpart DD - containment buildings; and
   11. (11) 40 CFR 264, Subpart EE - hazardous waste munitions and explosives storage.
