1. (a) Upon receipt of a hazardous waste accompanied by a manifest, the owner, operator, or responsible agent of the designated facility shall comply with 40 CFR 264.71(a) through (k) and 40 CFR 265.71(a) through (k), as applicable, with 40 CFR 264.71(c) and 40 CFR 265.71(c) amended to read as follows:

   “(c) Whenever a shipment of hazardous waste is initiated from a facility, the owner or operator of that facility must comply with the requirements of Env-Hw 500. The provisions of Env-Hw 500 apply to owners or operators that are shipping hazardous waste which they generated at that facility or operating as a large quantity generator consolidating hazardous waste from very small quantity generators under Env-Hw 509.02(e).”

2. (b) The export and import requirements of 40 CFR 264.71(a)(3) and (d) and 40 CFR 265.71(a)(3) and (d) shall not apply to a NH-only waste.
