1. (a) If the department determines that the information required by Env-Hw 406.02 has been submitted but is insufficient for the department to determine whether the criteria in Env-Hw 406.03(b) have been met, the department shall notify the petitioner in writing of the additional information, including laboratory analytical data from representative samples of the waste, believed by the department to be necessary to evaluate the petition.
2. (b) The notice shall specify the information needed and the deadline for submitting the information, as determined based on the type and volume of information.
