(a) Before a used oil marketer directs the first shipment of off-specification used oil fuel to a used oil burner, they shall obtain a one-time written and signed notice from the used oil burner certifying that the used oil burner:
- (1) Has submitted notification of the burner’s used oil management activities to the department, or if out of state, to the state or EPA region in which the burner is located; and
- (2) Will burn the off-specification used oil only in an industrial furnace or boiler identified in Env-Hw 1409.03(a).
- (b) Certifications described in (a), above, shall be kept as specified in Env-Hw 1410.07(a)(3).
