1. (a) Except as provided in (b), below, this part shall apply to used oil fuel marketers.

2. (b) The following persons shall not be considered used oil fuel marketers subject to this part:

   1. (1) A used oil generator, household DIY used oil collection center, commercial used oil collection center, or used oil aggregation point, or a used oil transporter that transports used oil received only from such entities, that directs a shipment of used oil to a used oil processor/re-refiner that incidentally burns used oil as described in Env-Hw 1409.01(b)(2);
   2. (2) A person who directs shipments of on-specification used oil and who is not the first person to claim the oil meets the used oil fuel specifications of Env-Hw 1404.02; and

   3. (3) A used oil generator, or the owner or operator of a household DIY used oil collection center, commercial used oil collection center, or used oil aggregation point, that:

      1. a. Tests and burns used oil onsite in compliance with Env-Hw 1406.04; or
      2. b. Directs used oil to a used oil burner that has notified and operates as a used oil fuel marketer under this part.
