(a) A used oil burner shall keep the following records:
(1) For at least 3 years from the date of acceptance, a record of acceptance for each used oil shipment accepted for burning, in the form of a log, invoice, manifest, bill of lading, or other shipping document, that includes:
- a. The name, address, and EPA identification number of the transporter that delivered the used oil to the used oil burner;
- b. The name, address, and if applicable, EPA identification number of the generator or processor/re-refiner from which the used oil was sent;
- c. The quantity of used oil accepted; and
- d. The date of acceptance;
- (2) Information gathered and records and results of used oil analyses performed, as applicable, to demonstrate compliance with Env-Hw 1409.03(d), for at least 3 years from the date the used oil burner last receives a shipment of specification used oil from that used oil handler; and
- (3) The certification required in Env-Hw 1409.07, for at least 3 years from the date the used oil burner last receives a shipment of off-specification used oil from that used oil handler.
- (b) The 3-year record retention period for the records specified in this section shall be extended automatically while any enforcement action is pending.
