(a) Before a used oil burner accepts the first shipment of off-specification used oil from a used oil handler, the used oil burner shall provide to the used oil handler a one-time written and signed notice certifying that the used oil burner:
- (1) Has submitted notification of the burner’s used oil management activities to the department, or if out of state, to the state or EPA region, as applicable, in which the burner is located; and
- (2) Will burn the off-specification used oil only in an industrial furnace or boiler identified in Env-Hw 1409.03(a).
- (b) Copies of the certifications required by this part shall be maintained by the used oil burner as specified in Env-Hw 1409.08(a)(3).
