1. (a) A used oil burner shall not burn used oil without an EPA identification number.

2. (b) A used oil burner shall notify the department by completing and submitting:

   1. (1) Form HWM-2 “RCRA C Site Identification Form” as amended August 2025; and
   2. (2) The following certification: “I certify, in accordance with Env-Hw 207, under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the information, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fines and imprisonment for knowing violations.”
3. (c) Such notification shall serve as an application for an EPA identification number.
4. (d) If the used oil burner has not provided all of the information specified in Form HWM-2 “RCRA C Site Identification Form” as amended August 2025, the department shall notify the used oil burner in writing of each deficiency.
5. (e) If the used oil burner does not respond to the department’s written notification of deficiencies and correct the deficiencies identified therein within 30 days of such notice, then no EPA identification number shall be assigned and the used oil burner shall submit a new notification prior to burning any used oil.
6. (f) If a used oil burner’s notification is complete in that it includes all information specified in Form HWM-2 “RCRA Site C Identification Form” as amended August 2025, the department shall assign an EPA identification number.
7. (g) A used oil burner shall notify the department, on Form HWM-2 “RCRA C Site Identification Form” as amended August 2025, of any changes to the information required by (b), above, within 30 days of such a change.
