1. (a) Off-specification used oil shall be burned only in the following devices:

   1. (1) Industrial furnaces;

   2. (2) Boilers, as defined in Env-Hw 103, that are:

      1. a. Industrial boilers located on the site of a facility engaged in a manufacturing process where substances are transformed into new products, including the component parts of products, by mechanical or chemical processes; or
      2. b. Utility boilers used to produce electric power, steam, heated or cooled air, or other gases or fluids for sale;
   3. (3) Used oil-fired space heaters under the provisions of Env-Hw 1406.04; or
   4. (4) Hazardous waste incinerators subject to regulation under Env-Hw 300 and Env-Hw 700.

2. (b) Specification used oil shall be burned only in the following devices:

   1. (1) Oil furnaces and boilers that are not located at private residences, hotels, motels, apartment buildings, and residential institutions including hospitals, residential treatment facilities, and nursing homes;
   2. (2) Used oil-fired space heaters, provided the heater is designed to have a maximum capacity 0.5 million Btu per hour, and combustion gases from the heater are vented to the outside ambient air; or
   3. (3) Any device specified in (a), above.
3. (c) Used oil containing greater than or equal to 2 ppm PCBs shall be burned in compliance with 40 CFR 761, pursuant to the Toxic Substances Control Act.

4. (d) Prior to burning used oil, the owner or operator of a device in (b)(1) or (b)(2), above, shall determine whether the used oil meets the specifications in Env-Hw 1404.02 by:

   1. (1) Performing analyses of the used oil as specified in Env-Hw 1404.01;

   2. (2) Applying knowledge that the used oil has not been mixed or contaminated with any other wastes, provided that the used oil is either:

      1. a. Automotive used oil generated by the used oil burner; or
      2. b. Household DIY used oil received directly from household DIY used oil generators; or
   3. (3) If the used oil was received from a used oil processor/re-refiner or used oil fuel marketer subject to Env-Hw 1408 or Env-Hw 1410, respectively, using information provided for each shipment of used oil.
