(a) A used oil processor/re-refiner shall notify the department within 30 days after ceasing used oil processing at a particular site by completing and submitting:
- (1) Form HWM-2 “RCRA C Site Identification Form” as amended August 2025; and
- (2) The following certification: “I certify, in accordance with Env-Hw 207, under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the information, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fines and imprisonment for knowing violations.”
(b) Owners and operators that store or process used oil in aboveground tanks shall comply with the following requirements:
- (1) At closure of a tank system, the owner or operator shall remove used oil and used oil residues from tanks and remove or decontaminate contaminated containment system components, soils, structures, and equipment, and manage such components, soils, structures, and equipment in accordance with Env-Hw 400 and Env-Hw 500, as applicable; and
- (2) If the owner or operator demonstrates that not all contaminated soils can be practicably removed or decontaminated as required in (b)(1), above, then the owner or operator shall close the tank system and perform post-closure care in accordance with the closure and post-closure care requirements that apply to hazardous waste landfills in 40 CFR 265.310.
(c) Owners and operators that store used oil in containers shall comply with the following requirements:
- (1) At closure, containers holding used oils or residues of used oil shall be removed from the site; and
- (2) The owner or operator shall remove used oil residues and remove or decontaminate contaminated containment system components, soils, structures, and equipment, and manage such components, soils, structures, and equipment in accordance with Env-Hw 400 and Env-Hw 500, as applicable.
