1. (a) Used oil processors/re-refiners shall comply with the requirements of Env-Hw 1405, Env-Hw 1408.03 through Env-Hw 1408.11, and, as applicable:

   1. (1) Env-Hw 1406 for generating used oil;
   2. (2) Env-Hw 1407 for transporting used oil and operating a used oil transfer facility;
   3. (3) Env-Hw 1409 for burning used oil for energy recovery, except as provided in (b), below; and
   4. (4) Env-Hw 1410 for acting as a used oil fuel marketer.

2. (b) A used oil processor/re-refiner that burns used oil for energy recovery shall not be subject to Env-Hw 1409 if:

   1. (1) The used oil is burned in an onsite space heater that meets the requirements of Env-Hw 1406.04; or
   2. (2) The used oil is burned for purposes of processing used oil, which is considered burning incidental to used oil processing.
