- (a) Except as provided in (b), below, this part shall apply to owners and operators of facilities that process used oil regulated under this chapter.
(b) This part shall not apply to:
- (1) A used oil generator that performs the activities described in Env-Hw 1406.03;
- (2) A used oil transporter that conducts the activities specified in Env-Hw 1407.03(c); or
- (3) A used oil burner that conducts incidental processing operations during the normal course of used oil management prior to burning as provided in Env-Hw 1409.04.
