(a) A used oil transporter shall comply with the recordkeeping requirements in Env-Hw 1405.02 and keep the following records for at least 3 years from the date of acceptance or delivery, as applicable:
(1) A record of acceptance, in the form of a bill of lading, manifest, or other shipping document, for each shipment of used oil accepted for transport, including:
- a. The name, address, and EPA identification number, if applicable, of the used oil handler that provided the used oil for transport;
- b. The quantity of used oil accepted;
- c. The date of acceptance; and
- d. The signature, dated upon receipt of the used oil, of a representative of the used oil handler that provided the used oil for transport, except that an intermediate rail transporter shall not be required to sign the record of acceptance;
(2) A record of delivery, in the form of a bill of lading, manifest, or other shipping document, for each shipment of used oil delivered to another used oil transporter, a used oil burner, or a used oil processor/re-refiner, including:
- a. The name, address, and EPA identification number of the receiving facility or used oil transporter;
- b. The quantity of used oil delivered;
- c. The date of delivery; and
- d. The signature, dated upon receipt of the used oil, of a representative of the receiving facility or transporter, except that an intermediate rail transporter shall not be required to sign the record of delivery; and
- (3) A record of delivery, as specified in (a)(2)a. through (a)(2)c., above, for each shipment of used oil exported to a foreign country.
- (b) The 3-year record retention period for the records specified in this section shall be extended automatically while any enforcement action is pending.
- (c) Pursuant to RSA 147-B:14, a transporter shall complete and submit Form HWM-11 “Annual Used Oil Transporter Report,” as amended August 2025, each year to report any used oil transported in the immediately preceding calendar year, as specified in (d) and (e), below.
- (d) A company official shall certify, as specified in Env-Hw 207, the report.
- (e) The report shall be submitted to the department by March 1 of the year immediately following the reporting year.
