- (a) Except as provided in (c) and (d), below, a used oil generator, household DIY used oil collection center, commercial used oil collection center, or used oil aggregation point shall ensure that its used oil is transported only by a used oil transporter that possesses an EPA identification number and a current and valid New Hampshire hazardous waste transporter registration.
- (b) If a shipment of used oil subject to regulation under this chapter is accompanied by a manifest, the NH01 hazardous waste number shall not be recorded on the manifest.
(c) Subject to the requirements of (d), below, a used oil generator, household DIY used oil collection center, or used oil aggregation point may self-transport the following, without obtaining an EPA identification number and a current and valid New Hampshire hazardous waste transporter registration:
- (1) Used oil that is generated at the generator’s site;
- (2) Used oil received while acting as a used oil aggregation point; and
- (3) Household DIY used oil received from household DIY used oil generators.
(d) For purposes of (c), above, the used oil shall be transported:
- (1) In a vehicle owned by the generator, household DIY used oil collection center, or used oil aggregation point, or an employee thereof;
- (2) In quantities of no more than 55 gallons of used oil at any time;
- (3) In containers that meet US DOT specifications for hazardous materials under 49 CFR 173; and
(4) Directly to:
- a. A used oil aggregation point that is owned or operated, or both, by the same generator;
- b. A commercial used oil collection center that has registered with the department in accordance with Env-Hw 1406.07; or
- c. A facility authorized under the destination state’s rules to handle the used oil.
- (e) A used oil generator, household DIY used oil collection center, commercial used oil collection center, or used oil aggregation point that wishes to direct a shipment of used oil from its facility to a used oil burner shall be subject to regulation as a used oil fuel marketer under Env-Hw 1410, except as provided in Env-Hw 1410.01(b).
