1. (a) A used oil generator, or the owner or operator of a household DIY used oil collection center, commercial used oil collection center, or used oil aggregation point, may burn used oil in a used oil-fired space heater provided that:

   1. (1) The heater burns only used oil that the owner or operator generates or used oil received from household DIY used oil generators;
   2. (2) The heater is designed to have a maximum capacity of 0.5 million Btu per hour;
   3. (3) The combustion gases from the heater are vented to the outside ambient air;
   4. (4) Except as specified in (c), below, analytical results confirm that the used oil meets the limits for onsite burning specified in Table 14.2, below; and

   5. (5) The used oil generator, household DIY used oil collection center, commercial used oil collection center, or used oil aggregation point:

      1. a. Notifies the department in accordance with Env-Hw 1409.05; and

      2. b. Complies with the applicable requirements of Env-A 1600 for fuel specifications and Env-A 2000 for fuel burning devices.

2. (b) A used oil generator, household DIY used oil collection center, commercial used oil collection center, or used oil aggregation point that burns used oil in a manner that does not meet one or more of the criteria in (a), above, shall be subject to regulation as a used oil burner, a used oil fuel marketer, or both, as applicable.

3. (c) A used oil generator, household DIY used oil collection center, commercial used oil collection center, or used oil aggregation point shall not be required to analyze used oil pursuant to (a)(4), above, if the used oil:

   1. (1) Has not been mixed or contaminated with any other wastes; and

   2. (2) Is either:

      1. a. Automotive used oil generated by the owner or operator; or
      2. b. Household DIY used oil received directly from household DIY used oil generators.
4. (d) The analytical results required in (a)(4), above, shall be maintained as specified in Env-Hw 1406.06(b).
