- (a) In the event of a release of used oil to the environment from an underground storage tank, a used oil handler shall comply with the applicable requirements of Env-Or 400, Env-Or 600, and 40 CFR 280 Subpart F.
(b) In the event of a discharge of used oil from a container or aboveground tank that meets one or more of the criteria in (c), below, a used oil handler shall report the discharge:
- (1) Immediately, not to exceed one hour from the discovery of the release; and
(2) To local emergency officials and to:
- a. The department’s emergency response team at the telephone number listed in Appendix E, Monday through Friday, 8 a.m. to 4 p.m.; or
- b. The New Hampshire state police headquarters communications unit at the telephone number listed in Appendix E, 24 hours per day.
(c) Criteria for immediate notification in accordance with (b), above, shall be as specified in Env-Or 604.06, including but not limited to:
- (1) A discharge of any oil into surface water or groundwater of the state;
- (2) A discharge of 25 gallons or more of oil to land;
- (3) A discharge of less than 25 gallons of oil to land, unless the discharge is cleaned up immediately and properly disposed of; or
- (4) A discharge of oil that results in the presence of vapors that pose an imminent threat to human health.
(d) Upon a release, the used oil handler shall:
- (1) Stop the release and contain the released used oil;
- (2) Clean up and properly manage the released used oil and other materials in accordance with this chapter and Env-Or 600; and
- (3) Repair or replace any leaking used oil storage containers or tanks prior to returning them to service.
