(a) In addition to the requirements of this section, used oil shall also be stored in accordance with all applicable local, state, and federal requirements, including:
- (1) Env-Or 300 – aboveground petroleum storage facilities;
- (2) RSA 153:1, VI-a – provisions of the state fire code that apply to flammable and combustible materials, as may be amended pursuant to RSA 153:5, I;
- (3) 40 CFR 112 – oil pollution prevention, including spill prevention, control, and countermeasures;
- (4) Env-Or 400 – underground storage tank facilities; and
- (5) 40 CFR 280 – technical standards and corrective action requirements for owners and operators of underground storage tanks.
- (b) A used oil handler shall store used oil only in tanks or containers.
- (c) Containers and tanks of used oil shall be maintained to prevent spillage, seepage, or other discharge of used oil into storm or sanitary sewers, onto the land, or into groundwater or surface waters.
(d) Used oil shall be stored in containers or tanks that are:
- (1) In good condition as specified in 40 CFR 279.22(b)(1), as provided in Appendix D;
- (2) Not leaking; and
- (3) Closed at all times except to add or remove used oil.
- (e) Used oil containers, aboveground tanks, and fill pipes used to transfer used oil into underground storage tanks shall be labeled or marked with the words “used oil”.
(f) While accumulating used oil in a container, a used oil handler shall:
- (1) Provide a minimum of 2 feet of aisle space to allow for inspection of at least one side of each container; and
- (2) Position each container so that its used oil label or marking is not hidden by walls or other containers and can be easily read without having to move any containers.
- (g) Spill control equipment, such as absorbent media, shall be available in case of spills or leaks.
- (h) Except as specified in (i), below, containers and tanks shall be stored on impervious surfaces. Impervious surfaces shall include concrete and asphalt with no cracks or holes present, and shall not include earthen, wooden, or gravel surfaces.
- (i) An existing tank shall be stored on an impervious surface except where portions of the existing tank meet the ground.
- (j) Used oil stored in areas with functional floor drains or manholes shall have secondary containment around all containers in the used oil storage area, capable of containing the volume of the largest capacity container present.
(k) Used oil containers stored outdoors shall:
- (1) Be covered to prevent precipitation from coming in contact with the tops of the containers, except when being moved to another location;
- (2) Be kept closed at all times except to add or remove used oil;
(3) Have secondary containment that:
- a. Is adequate to hold any spills or leaks at 110% of the volume of the largest container in the area or 10% of the total volume of containers, whichever is greater; and
- b. Is covered to keep the secondary containment structure free of rain, snow, and ice; and
(4) Not be stored within any of the following distances, unless a greater distance is required by any other federal standard, state statute, or rule in which case such distance shall apply:
- a. For surface waters, 50 feet;
- b. For private wells, 75 feet;
- c. The sanitary protective area of any public water supply well; or
- d. For storm drains, 50 feet.
