(a) Used oil shall be classified as off-specification used oil if it:
- (1) Exceeds one or more of the standards in Table 14.1, except as provided in (c), below;
- (2) Satisfies the rebuttable presumption pursuant to Env-Hw 1402.02(d), as applicable; and
- (3) Except as specified in Env-Hw 1402.03(b), has not been mixed with any other hazardous waste.
- (b) A used oil handler that blends off-specification used oil to meet the specification used oil standards in Env-Hw 1404.02 shall comply with the requirements for used oil processors/re-refiners in Env-Hw 1408.
- (c) Used oil containing PCBs at concentrations of 50 ppm or greater shall not be classified as off-specification used oil and instead shall be regulated as specified in Env-Hw 1402.09(c).
