The following shall be exempt from this chapter:

1. (a) A household DIY used oil generator; and

2. (b) A farmer who generates used oil from vehicles or machinery used on the farm, provided that:

   1. (1) The quantity generated does not exceed an average of 25 gallons per month in a calendar year; and
   2. (2) The used oil is not applied to the land.
