- (a) Except as noted in (b), below, used oil containing polychlorinated biphenyls (PCBs) at any concentration less than 50 ppm shall be subject to the requirements of this chapter and to the prohibitions and applicable requirements of 40 CFR Part 761, including 40 CFR 761.20(d) and (e).
- (b) If used oil containing 50 ppm or greater PCBs has been diluted to any concentration less than 50 ppm, the diluted used oil shall be regulated under 40 CFR Part 761 as a used oil containing PCBs at 50 ppm or greater and not regulated under this chapter.
(c) Used oil containing PCBs at concentrations of 50 ppm or greater shall not be subject to the requirements of this chapter but shall be subject to regulation:
- (1) Under 40 CFR part 761; and
- (2) As a hazardous waste unless exempt from regulation pursuant to Env-Hw 401.03(b)(25).
- (d) Dilution of used oil containing PCBs shall be prohibited unless otherwise specifically provided for in this chapter or 40 CFR 761.
