- (a) Materials, including re-refined lubricants, that are reclaimed from used oil, are used beneficially, and are not burned for energy recovery or used in a manner constituting disposal, shall be subject to Env-Hw 401.03(b)(39).
- (b) Materials produced from used oil that are burned for energy recovery, such as used oil fuels, shall be subject to regulation as used oil under this chapter.
- (c) Materials derived from used oil that are disposed of or used in a manner constituting disposal shall be subject to the applicable requirements of Env-Hw 100 through Env-Hw 800 and Env-Hw 1200 including the applicable requirements of Env-Hw 401.03(b)(26), rather than this chapter.
