- (a) Except as provided in (b), below, a mixture of used oil and any characteristic hazardous waste shall be regulated as a hazardous waste, rather than used oil under this chapter.
(b) A mixture of used oil and ignitable-only hazardous waste shall be managed under this chapter if:
- (1) A representative sample of the hazardous waste prior to mixing is hazardous only for the characteristic of ignitability as specified in Env-Hw 403.03(b);
- (2) A representative sample of the used oil and hazardous waste mixture has a flash point greater than 140°F; and
- (3) The used oil handler creating the mixture maintains documentation onsite documenting satisfaction of the requirements of (b)(1) and (2), above, for 3 years from the date the mixture was last handled.
