(a) This chapter shall apply to:
- (1) Used oil, as defined in Env-Hw 104, except as specified otherwise in this part;
- (2) Used oil generated, transported, collected, or marketed for purposes of recycling, including by being reused, re-refined, reclaimed, burned for energy recovery, or processed; and
- (3) Used oil burned for energy recovery.
- (b) Used oil that is destined to be recycled and also exhibits a hazardous waste characteristic, due to contamination through use and not as a result of being mixed with a hazardous waste, shall be subject to regulation under this chapter instead of Env-Hw 100 through Env-Hw 800 and Env-Hw 1200.
- (c) If used oil is disposed of or is not destined to be recycled, the used oil shall be regulated as NH01 listed hazardous waste pursuant to Env-Hw 402.06(c) and subject to regulation under Env-Hw 100 through Env-Hw 800 and Env-Hw 1200 instead of this chapter.
- (d) Used oil subject to RSA 339-B:2 and RSA 339-B:2-a shall be handled in accordance with the applicable requirements of this chapter.
