1. (a) Except as provided in (c), below, any person seeking to add a hazardous waste or a category of hazardous waste to this chapter shall petition for an amendment to Env-Hw 1100 in accordance with:

   1. (1) This part;
   2. (2) Env-Hw 206; and
   3. (3) 40 CFR 273 Subpart G.

2. (b) The petitioner shall submit the following information, in writing, to the department:

   1. (1) The petitioner's name and mailing address and, if available, an email address;
   2. (2) A statement explaining why the petitioner believes that the waste is a universal waste;
   3. (3) A description of the type of waste proposed to be included as a universal waste;
   4. (4) A description of the methods by which the waste can be managed;
   5. (5) A statement of the need and justification for adding the proposed waste to this chapter based upon the criteria in Env-Hw 1108.02, including any supporting tests, studies, or other pertinent information;
   6. (6) A statement explaining how the proposed universal waste will improve management practices for the waste or category of waste; and
   7. (7) A statement explaining how the proposed universal waste will improve implementation of the hazardous waste program.
3. (c) Hazardous waste pharmaceuticals regulated under Env-Hw 1300 shall not be added as a category of hazardous waste for management under this chapter.
