- (a) To receive HWCF monies for a household DIY used oil collection center, the applicant shall enter into a written agreement with the department.
(b) The applicant shall specify:
- (1) The name and location of the household DIY used oil collection center;
- (2) The products and services to be covered by the work plan; and
- (3) The amount of HWCF monies, calculated in accordance with Env-Hw 1004.05, to be awarded to the applicant upon completion of the work plan and submittal of the documentation required by Env-Hw 1004.07.
(c) The applicant shall submit:
- (1) Documentation demonstrating that the individual signing the agreement with the department is duly authorized to sign the agreement and expend funds for the project on behalf of the applicant;
- (2) A current certificate of insurance indicating that the applicant is insured in the amounts specified in the agreement;
- (3) A certification, as specified in Env-Hw 207, that the applicant is in compliance with the hazardous waste rules; and
- (4) A letter of commitment from each municipality, if the household DIY used oil collection center is owned or operated by more than one municipality.
- (d) The department shall make available an example of documentation demonstrating authority to sign the agreement and expend funds, as specified in (c)(1), above.
- (e) The agreement shall be approved and signed by the applicant and by the commissioner or designee. The agreement shall also be subject to approval by the governor and council and the New Hampshire department of justice, office of the attorney general, as applicable.
- (f) The department shall enter into an agreement with the applicant only if the applicant is in compliance with the hazardous waste rules.
