1. (a) In fulfilling its HWCF administrative responsibilities, the department shall base its recommendation to the governor on the amount of fund money to make available for household DIY used oil collection centers on the following considerations:

   1. (1) The total amount of money available in the HWCF; and
   2. (2) Present and anticipated needs for spending HWCF money for site cleanup operations and emergency response actions.

2. (b) Each fiscal year, the department shall allocate HWCF moneys in the following order of priority:

   1. (1) Political subdivisions without household DIY used oil collection centers;
   2. (2) Political subdivisions that have established household DIY used oil collection centers;
   3. (3) Other government entities;
   4. (4) State motor vehicle inspection stations; and
   5. (5) Non-profit organizations.
3. (c) The department shall award funds to entities with approved applications in accordance with the priorities established in (b), above, until all allocated funds have been expended for the fiscal year.
