To request approval to install and use non-central treatment devices, the PWS owner shall submit the following in writing to the department:
- (a) The name, location, and PWS identifier of the system;
- (b) Whether POE or POU devices are proposed to be used, and the contaminant(s) proposed to be treated by the devices;
- (c) An explanation, with supporting documentation, of the PWS owner’s attempts to locate alternate water sources;
- (d) An explanation, with supporting documentation, of why centralized treatment is not feasible;
(e) If POE devices are proposed to be used:
- (1) An explanation of why POU devices are not feasible;
- (2) A rigorous engineering design review of the POE devices; and
(3) A demonstration that:
- a. The design and application considers the tendency for increase in heterotrophic bacteria concentrations in water treated with activated carbon; and
- b. Where necessary, requires the use of frequent backwashing, post-contactor disinfection, and heterotrophic plate count monitoring to ensure that the microbiological safety of the water is not compromised;
- (f) Certification under NSF/ANSI 53 Health Effects or equivalent alternative proof of performance to show that the non-central treatment device(s) proposed is effective in reducing the contaminant concentration to below the applicable MCL;
- (g) The results of field testing for POE devices conducted pursuant to 40 CFR 141.100, if applicable;
(h) An operations and maintenance plan that explains how:
- (1) All devices will be operated, scheduled for media or cartridge replacement, and monitored for total flow treated; and
- (2) Records will be maintained to ensure all devices are operated correctly to ensure the contaminant is treated as proposed; and
(i) Unless the certified operator is employed directly by the PWS, a contract with a certified operator that:
- (1) Specifies the operator’s obligations to maintain and sample all installed non-central treatment devices;
- (2) Is for an initial term of not less than one year; and
- (3) Is subject to renewal not more frequently than once each year.
