The rules in this part shall apply to any CWS or NTNC, other than one owned by a political subdivision, that:

1. (a) Receives a notice under Env-Dw 603.02(a) that it has exceeded the deficiency rating as specified in Env-Dw 603.02(b); or
2. (b) Receives an order from the department under RSA 485:4 or RSA 485:58 to comply with these rules.
