- (a) Whenever it appears that demand will exceed supply on an emergency or short-term basis, the owner of the PWS shall take appropriate action(s) to reduce nonessential demand.
- (b) Whenever a drought is declared in the region of the PWS, the owner of the PWS shall take such action(s) as the owner deems necessary to reduce nonessential demand.
- (c) Reduction of demand shall be considered as an emergency response achievable by directive from the PWS to its customers.
- (d) The owner of a PWS shall inform the department of any action(s) taken or directed to reduce customer demand on a short-term or emergency basis within 3 working days of taking or directing such action(s).
- (e) If a water shortage necessitating the reduction of nonessential demands occurs on an annual basis, the shortage shall not be considered an emergency situation that can be addressed under this section.
