1. (a) Except as otherwise required by these rules, collection, treatment, distribution, and storage components and all other appurtenances of all large CWSs and those CWSs providing fire protection by means of street hydrants shall be designed in accordance with the practices and standards set forth in the 2022 edition of “Recommended Standards for Water Works,” committee report of the Great Lakes - Upper Mississippi River Board of State and Provincial Public Health and Environmental Managers, available as noted in Appendix B, with the following exceptions and as further modified by paragraphs (b) and (c) below and Env- Dw 404.05:

   1. (1) The foreword; and

   2. (2) The following sections related to well construction methods:

      1. a. Section 3.2.6.2 (b)(5); and
      2. b. Section 3.2.6.5.
2. (b) If the local legislative body of a political subdivision which owns a PWS does not vote to approve funding for the requirements of the 2022 edition of the "Recommended Standards for Water Works" as compared to the 1982 edition thereof and the improvements are not fully funded by the state, the department shall not require the improvements to be implemented.

3. (c) The following terms used in the document adopted by reference at paragraph (a) above, shall be defined, as follows:

   1. (1) “100-year flood elevation” means the flood hazard elevation determined in accordance with Env-Dw 404.05(o). This term also includes “highest flood of record”;
   2. (2) “Subject to flooding” means below the flood hazard elevation;
   3. (3) “Outside flood plains,” “free from flooding,” and “protected from flooding” means above the flood hazard elevation; and
   4. (4) “Flood plain” means the area below the flood hazard elevation.
