- (a) The rules of this part shall apply to CWSs, as defined in Env-Dw 103.11, that are large community water systems as defined in Env-Dw 103.27, have fire protection provided by street hydrants, or use surface water as a source of water supply.
- (b) Requirements for small community water systems as defined in Env-Dw 103.55 are set forth in Env-Dw 302, Env-Dw 305, and Env-Dw 405, as applicable.
- (c) For existing large CWSs that propose to expand or be modified, the design criteria of this part shall apply only to the component(s) of the CWS affected by the proposed expansion, modification, or both. For the purposes of this section, “modified” means altered, added to, or enlarged.
- (d) No person shall connect a new or existing well to a large CWS without prior approval obtained in accordance with Env-Dw 302 and this part.
- (e) Any existing water supply source for a large CWS that has not previously been approved by the department shall meet the requirements specified in Env-Dw 302.
- (f) No person shall start up a large CWS without obtaining approval for the final design in accordance with Env-Dw 404.03 and without completing the post-construction procedures required by Env-Dw 404.06.
- (g) No person shall connect a large CWS to any other PWS without obtaining approval for the final design in accordance with Env-Dw 404.03 and without completing the post-construction procedures required by Env-Dw 404.06.
- (h) Subject to (i) below, no person shall perform modifications to an existing large CWS collection, treatment, storage, or distribution facility, including hydraulic and pumping infrastructure, that could adversely affect public health, without approval from the department in accordance with Env-Dw 404.08 below.
- (i) Examples of modifications that could adversely affect public health include, but are not limited to, addition or replacement of storage tanks, water treatment facilities, pumping facilities, and distribution piping or addition of service connections.
- (j) Replacement of 500 feet, or less, of piping with no new service connections or change in pipe size shall not require approval from the department provided the piping is replaced in accordance with the design criteria in Env-Dw 404.04 and Env-Dw 404.05.
