1. (a) A person shall obtain approval from the department in accordance with Env-Dw 302.05 through Env-Dw 302.31 prior to:

   1. (1) Developing a new production well for a large CWS, regardless of whether the well is a small production well or a large production well;
   2. (2) Requesting an increase in the permitted production volume of an existing well currently connected to a large CWS; or
   3. (3) Requesting an increase in the permitted production volume of an existing small production well connected to any CWS if the increase would result in a permitted production volume of equal to or greater than 57,600 gallons in a 24-hour period.
2. (b) Any person proposing to construct a back-up production well for a large CWS and any person proposing to construct a back-up well for a small CWS where the well would qualify as a large production well shall submit a request to the department in accordance with Env-Dw 302.34.
3. (c) Any person proposing to replace a large production well shall submit a request to the department in accordance with Env-Dw 302.35.
