“Resident project representative” means an individual who:

1. (a) Is qualified to the satisfaction of the recipient, in consultation with the department, by reason of education and experience to inspect construction projects; and
2. (b) Reports to a licensed professional engineer when the project’s plan and scope of work indicate supervision by an engineer is required.
