1. (a) The department shall include the applicant’s project on the preliminary project priority list (PPL) prepared pursuant to Env-Dw 1105.02 if:

   1. (1) The pre-application contains sufficient information for the department to determine the identity of the applicant and the applicant’s POC, the nature and scope of the proposed project, and the term and amount of funding likely to be needed;
   2. (2) The applicant is an eligible entity; and
   3. (3) The proposed project meets the criteria specified in Env-Dw 1104.01 and Env-Dw 1104.02.
2. (b) If the applicant’s project does not meet the criteria in (a), above, to be placed on the preliminary PPL, the department shall notify the applicant of the reason(s) why in writing within 14 days of making the determination.
3. (c) In response to being notified that a project cannot be placed on the preliminary PPL, an applicant that is an eligible entity may modify or supplement any information and submit a new pre-application to the department no later than the end of the public comment period established pursuant to Env-Dw 1105.04(b)(2).
