“Participant” means:

1. (a) For an adjudicative proceeding, a respondent, intervenor, or representative of the department for that adjudicative proceeding; or
2. (b) For a non-adjudicative proceeding, any person who attends the hearing or submits comments in writing on paper or by e-mail, or both.
