1. (a) The department shall provide the following to EPA:

   1. (1) A copy of the permit application or, upon agreement with EPA, a summary thereof, unless the applicant has filed a copy of the permit application with EPA pursuant to Env-A 609.06(d);
   2. (2) A written statement regarding the legal and factual basis for all permit conditions contained in any draft title V operating permit, including references to the applicable statutory or regulatory provisions:
   3. (3) After the end of the public comment period specified in Env-A 622.02, a copy of the proposed title V operating permit; and
   4. (4) A copy of the final title V operating permit, if issued.

2. (b) Pursuant to 40 CFR §70.8(c), the EPA shall have 45 days from the date of receipt of a proposed title V operating permit to object, in writing, to the issuance of the proposed permit if EPA determines the proposed permit is not in compliance with applicable requirements of the title V operating permit program or

   the rules promulgated thereunder.
