1. (a) Within 30 working days after the close of the comment period specified in Env-A 621.02(d)(5), Env-A 621.03, or Env-A 621.04(c)(9), in accordance with the requirements of RSA 125-C:11, the department shall:

   1. (1) Approve the application, issue the permit(s) subject to conditions, and set forth in writing the findings with an explanation of the basis of such approval;
   2. (2) Deny the application and set forth in writing the findings with an explanation of the basis of such disapproval; or
   3. (3) Schedule a hearing to be conducted in accordance with the provisions of Env-A 203, and notify the applicant and the person(s) who requested such hearing.
2. (b) Within 30 working days after the close of the comment period following a public hearing, the department shall issue a decision pursuant to either (a)(1) or (a)(2), above.
3. (c) In making the decision, the department shall consider the application, all written comments received during the public comment period specified in the public notice issued pursuant to Env-A 621.02(d)(5), Env-A 621.03, or Env-A 621.04(c)(9), as well as the applicant's written response thereto, and any testimony presented at the public hearing, if one was held.
