1. (a) This section shall apply to all permit applications except those subject to the requirements of:

   1. (1) Env-A 609, relating to title V permits;
   2. (2) Env-A 610, relating to general permits;
   3. (3) Env-A 611, relating to acid rain permits;

   4. (4) Env-A 612, relating to:

      1. a. Amendments, modifications, and revisions of title V permits; and
      2. b. Minor permit amendments of temporary permits and state permits to operate;
   5. (5) Env-A 618, relating to temporary permits subject to nonattainment requirements; and
   6. (6) Env-A 619, relating to PSD permits.
2. (b) Within 10 days after the completion of a draft temporary permit, draft permit to operate, or draft decision to deny the application with supporting findings of fact, the department shall prepare a public notice of the receipt of the permit application and the intent to issue, amend, or deny such permit.

3. (c) Public notice of the intent to issue, amend, or deny a temporary permit or permit to operate shall contain the following information:

   1. (1) The name and address of the applicant;
   2. (2) The location of the source;
   3. (3) A brief description of the stationary source, area source or device sought to be permitted;
   4. (4) The location(s) where, and the hours during which, the completed application and other pertinent information may be examined; and
   5. (5) The date by which, and the address where, written comments or requests for a public hearing shall be filed.
4. (d) The deadline for written comments or public hearing requests shall not be sooner than 30 days after the publication of the notice.
5. (e) The public notice shall be published by either the department or the applicant, at the applicant’s option, once in a newspaper of general daily circulation and once in a newspaper of general circulation in the area in which the source is located.

6. (f) The applicant shall provide to the department:

   1. (1) Proof of each publication of the notice if the applicant publishes it; or
   2. (2) Payment of the publication costs incurred by the department and an administrative fee of $15.00 if the applicant requests the department to publish the notice.
