1. (a) The owner or operator of a source or device shall file with the department a request for a minor permit amendment for any proposed change to an existing permit condition which:

   1. (1) Does not qualify as either an administrative permit amendment, as defined in Env-A 102, or a significant permit amendment, as specified in Env-A 612.04; or
   2. (2) Incorporates the requirements of a temporary permit, general state permit, or RACT order into an existing state permit to operate.

2. (b) The request for a minor permit amendment shall:

   1. (1) Be in the form of a letter to the department;
   2. (2) Describe the proposed change; and
   3. (3) Describe any new requirements that will apply if the change occurs.
3. (c) The department shall take final action on a request for a minor permit amendment within 90 days of receipt of a request filed pursuant to (a) and (b), above.
4. (d) The owner or operator may implement the proposed change immediately upon filing a request for minor permit amendment with the department, but shall be subject to enforcement if the department later determines that the change violated any applicable state or federal requirement.
