1. (a) If an applicant files a timely and complete application for the issuance or renewal of a title V operating permit, the failure to have a title V operating permit shall not be considered a violation of this part unless and until the department denies the requested permit and:

   1. (1) The applicant does not appeal the denial within the time specified in RSA 125-C:12, III; or
   2. (2) The denial is affirmed after all available appeals have been exhausted.
2. (b) The protection granted in (a), above, shall cease to apply if the applicant fails to file in writing any information requested by the department pursuant to Env-A 609.12, by the deadline specified.
