1. (a) The owner or operator may request a reissuance of a state permit to operate for a period not to exceed 2 years if:

   1. (1) Required compliance testing is not complete by the designated expiration date;
   2. (2) The owner or operator is in the process of obtaining a permit or permits from another governmental entity;
   3. (3) The owner or operator is involved in a dispute where a permit from another governmental entity has been issued and appealed; or
   4. (4) The operation of the device or source will be discontinued within 2 years after the designated expiration date.
2. (b) The owner or operator shall file a written request for a reissuance, specifying the basis for such request and including a certification pursuant to Env-A 605.04(c), with the department at least 90 days prior to the designated expiration date of a state permit to operate.
