1. (a) For a source or device that has been issued a temporary permit, an application for an initial state permit to operate or the incorporation of the provisions of the temporary permit into an existing state permit to operate shall be considered timely if it is filed with the department at least 90 days prior to the designated expiration date of the temporary permit.
2. (b) For a source or device that has been issued a state permit to operate, an application for renewal of the permit shall be considered timely if it is filed with the department at least 90 days prior to the designated expiration date of the current state permit to operate.
