1. (a) If an applicant files a timely application that has been deemed complete by the department for the reissuance of a temporary permit, the issuance of an initial state permit to operate, or the incorporation of the provisions of a temporary permit into an existing state permit to operate or Title V operating permit, the failure to have a current and valid temporary permit shall not be considered a violation of RSA 125-C:11 or Env-A 607.01 unless and until the department denies the requested reissuance and:

   1. (1) The applicant does not appeal the denial within the time specified in RSA 125-C:12, III; or
   2. (2) The denial is affirmed after all available appeals have been exhausted.
2. (b) If the department deems an application complete, but requests additional information pursuant to Env-A 607.06(b), the protection granted in (a), above, shall cease to apply when the applicant fails to file in writing such additional requested information by the deadline specified in the request.
